Actor Dorien Wilson arrested for DUI

In February of 2015, the headlines read Actor Dorien Wilson arrested for DUI.  Unfortunately for Wilson this was his second DUI arrest in six years.  The Legislatures and the Courts have become more and more punitive of persons convicted of DUI over the last ten or fifteen years.  In many jurisdictions, persons convicted of a second DUI within five years or ten years or life time face even harsher penalties than first time offenders.  In many jurisdictions, a third DUI conviction within ten years is a felony; in some jurisdictions a third DUI conviction in a lifetime is a felony.  Most of those felony convictions require mandatory incarceration measured in months.  Wilson’s prior DUI conviction was in 2009. Officer gave false DUI testimony

In her July 31, 2015 order, Jefferson County Kentucky District Court Judge Stephanie Burke found that Officer Jeff Eberenz had testified falsely.  Judge Burke then dismissed the relevant DUI case because the traffic stop was not legal.   The false testimony dealt with the certification of the radar gun used by Officer Eberenz and his testimony about such certification.  Under oath in a January hearing Officer Eberenz testified that he had properly certified the relevant radar gun and maintained it every shift.  Officer Everenz stated, “I use a tuning fork to verify stationary speed and two tuning forks to verify the calibration for moving speeds.”  In contrast to the Officer’s sworn testimony the Court learned that maintenance records showed the relevant radar gun had not been properly certified since April 2011, almost three years before the relevant stop. Officer gave false DUI testimony:  “It is almost without question that Officer Eberenz knew his statements were false,” Burke wrote. “It would be difficult to imagine that Officer Eberenz would be unfamiliar with the maintenance history of the machine which he relies upon on a regular, if not daily basis, particularly when he was so emphatic in his testimony to the contrary.” To make matters worse the video did not support the Officer’s claim that the relevant Accused failed to use his turn signal or that he was speeding.  Prosecutors are concerned because once an Officer is determined to testify falsely it may negatively affect his ability to successfully prosecute cases.  Apparently Officer Eberenz has dozens of DUI and speeding cases pending.  Officer Eberenz may have some issues with his employer, the Louisville Metro...

Jeremih Arrested For DUI on his Birthday

In mid-July, 2015 the headlines read: Jeremih Arrested For DUI on his Birthday.  Jeremih Felton who performs under the mononym Jeremih is a recording artist and producer.  Jeremih is signed with Def Jam. Jeremih’s breakout single was Birthday Sex, an ironic title given his arrest in 2015 on his Birthday.  Jeremih’s first album was Jeremih and rose to within the top ten on Billboard 200.  In 2010 he released Down on Me which made it to within the top 5 on Billboard Hot 100.  In 2014 he had Don’t Tell ‘Em which made it to the top ten on Billboard Hot 100.  Jeremih’s fans are awaiting his 2015 release Late Nights. NY Jet Sheldon Richardson arrested for excessive speeding

In July, 2015 the headlines read: NY Jet Sheldon Richardson arrested for excessive speeding.  After being stopped, Richardson was charged with driving an excessive speed, resisting arrest, failure to use headlights, failure to obey traffic control device and following too closely.  The police report indicates that Richardson was clocked at speeds in excess of 140 miles per hour .  The report also indicates that Richardson had both a firearm and a twelve year old child in his Bentley as he sped down the highway.  Richardson also had two adult male passengers.  The firearm did not engender any charges since Richardson was legally in possession of the firearm. Richardson was drafted by the New York Jets in the first round of the 2013 NFL Draft.  Richardson played college ball after his first two years at the University of Missouri.  Richardson was suspended from the team in late 2012 and decided to enter the draft rather than finishing his senior year.  The Jets signed Richardson to a four year deal for slightly over 10 million dollars.  The Jets started Richardson at defensive end for the 2013 season.  Richardson won NFL Rookie of the Month in November, 2013.  The Jets also used Richardson as a fullback on a few plays during the 2013 season.  Richardson became the first NFL Defensive Lineman to score a rushing touchdown since 2011.  Richardson was designated the 2013 NFL Defensive Rookie of the Year.  Richardson was selected for the 2014 Pro Bowl.
